Terms and Conditions of Sale

These general terms and conditions of sale (GTC) govern all commercial relations between CPH Parfums, SAS, with a share capital of €1045.05, registered with the RCS of Paris, France on 11/02/2015, under the number 814 326 518 000 36, headquartered at 14 RUE DU FAUBOURG SAINT HONORÉ, 75008 PARIS, FR, phone: +33983727860, email: parfums@marcantoinebarrois.com, VAT number: FR34814326518, hereinafter referred to as "the Publisher," and any person, natural or legal, private or public, registered on the Site to purchase a Product, hereinafter referred to as "the Customer."

1. Purpose

These GTC aim to define the terms of sale between the Publisher and the Customer, from order placement to delivery, including payment and use of the services offered.

2. Orders

Any order placed on our site implies full and unconditional acceptance of these GTC. Orders are confirmed by email and are only valid after our confirmation.

3. Products

The products offered for sale are those described on our site. We take the utmost care in presenting and describing these products to provide you with the best possible information.

4. Prices

Prices are indicated in euros, inclusive of all taxes (VAT included), including the VAT applicable on the day of the order. Prices may be changed at any time without notice.

5. Payment

Order payments are made by credit card through a secure transaction. Ordered products remain the property of the Publisher until full payment is received.

6. Delivery

Deliveries are made to the address indicated when placing the order. Delivery times are indicative and may vary depending on transport conditions. Delivery charges are calculated based on the weight and destination of the ordered products. Delivery times are estimated between 3 and 7 business days for deliveries within mainland France.
For shipments outside the European Union (including Switzerland and Norway), customs clearance fees and local VAT may be charged by the carrier upon delivery. These fees are the responsibility of the recipient and are not included in the order price.

7. Return and Refund Policy

7.1 Right of Withdrawal

In accordance with applicable legal provisions, the Customer has a period of 14 calendar days from the receipt of the Product to exercise their right of withdrawal without having to justify reasons or pay penalties.

7.2 Exercising the Right of Withdrawal

To exercise the right of withdrawal, the Customer must notify their decision to withdraw by sending an email to parfums@marcantoinebarrois.com or by contacting customer service at +33983727860. A standard withdrawal form can be provided upon request.

7.3 Return of Products

The Customer must return the Product at their own expense, in its original packaging, complete and in perfect condition, to the following address:

Damaged, soiled, or incomplete products will not be accepted.

7.4 Refund

The refund of the returned Product will occur within 14 days from the receipt by the Publisher of the withdrawal request, provided that the Product has been recovered or that the Customer has provided proof of shipment of the Product. The refund will be made using the same payment method used by the Customer for the order, unless the Customer expressly agrees to another refund method.

7.5 Exclusions from the Right of Withdrawal

According to legal provisions, the right of withdrawal cannot be exercised for:

• Personalized products or products made according to the Customer's specifications.
• Products unsealed by the Customer after delivery and that cannot be returned for hygiene or health protection reasons.

8. Privacy Policy

We collect and process your personal data in accordance with our Privacy Policy. Your information will never be shared with third parties without your explicit consent.

9. Terms of Use

By using our site, you agree to comply with the terms of use available on our site. Any fraudulent or improper use of the site will result in prosecution

10. Liability

The Publisher cannot be held responsible for damages resulting from improper use of the purchased product. Our liability is systematically limited to the value of the product in question, determined on the date of its sale.

11. Applicable Law

These GTC are subject to French law. In case of a dispute, French courts will have exclusive jurisdiction.

12. Dispute - Consumer Mediation

In the event of a dispute between the Customer and the Company, both parties shall endeavor to resolve it amicably (the Customer shall submit a written complaint to the professional or, where applicable, to the professional’s Customer Relations Department).

Failing an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Customer, within the meaning of Article L.612-2 of the French Consumer Code, may, if the dispute persists, refer the matter free of charge to the competent mediator listed by the Commission for the Evaluation and Control of Consumer Mediation in accordance with Article L.615-1 of the French Consumer Code, namely:
